1. Who You're Buying From
Orders placed through Truq are placed with and fulfilled by the independent food truck or mobile vendor (“Vendor”) whose menu you are ordering from. Truq is a technology provider only — we provide the ordering platform; we do not prepare, sell, or fulfill any food or goods.
Refunds, order issues, and questions about quality, safety, or fulfillment are handled by, or through, the Vendor. A refund issued through Truq is for the full amount of your order, including tax, tip, and any service fee you paid. Contact support@gotruq.com if you need help reaching a Vendor about an order.
2. Text Message Program
If you provide your phone number and check the consent box at checkout, Truq will send you text messages (SMS/MMS) about your order status — for example, confirmation and ready-for-pickup notifications — on behalf of the Vendor you ordered from.
- You may receive up to 3 messages per order placed.
- Consent to receive text messages is not a condition of purchase.
- Message and data rates may apply depending on your mobile carrier and plan.
- Reply STOP to opt out at any time, or reply HELP or contact support@gotruq.com for assistance.
Carriers are not liable for delayed or undelivered messages.
3. Payments
Payments are processed by Stripe, Inc. Truq charges a fee on each order, currently 3.5% of the order subtotal (the items, before tax and tip), capped at $3.00 per order. Depending on the Vendor, either you pay this fee, and it is shown at checkout as a “Service fee” before you complete your order, or the Vendor pays it, and no service fee is shown. Tips are optional and available only where the Vendor accepts them; you can always choose no tip. Truq takes no portion of tips, and no sales tax is charged on tips. The service fee is not a tip and does not go to the Vendor or its staff. Sales tax, when charged, is calculated from the Vendor's tax settings and shown at checkout. The Vendor is the merchant of record for your purchase.
4. Acceptable Use; Disclaimer; Limitation of Liability
You agree to use the Platform only for lawful purposes and not to interfere with its operation or misuse any Vendor's ordering page.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRUQ IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF ANY VENDOR'S PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUQ'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF TRUQ'S FEE ON THE ORDER GIVING RISE TO THE CLAIM (AS DESCRIBED IN SECTION 3), WHETHER PAID BY YOU OR BY THE VENDOR. TRUQ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
5. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflicts of law principles.
